Six IRONMAN sell-out events across Europe in 2021- postponed!
Life happens – at the moment we can’t seem to race when we want and where we want. None more so than for those in the Ironman Community who signed up to race in the early part of 2021. IRONMAN have announced that they will be postponing six of their European Group series early season races until later in the year. Alternative dates are being arranged for later in the season of 2021.
There has been a backlash on social media platforms regarding the Ironman no money-back option, instead offering deferral to a different date, or transfer to a different race. Athletes are understandably upset and frustrated, nonetheless, there are a number of waivers and terms and conditions they accept and agree to which includes a “no refunds” clause. Those participants who believe the deferral options offered are not equivalent to what they bargained for and the refusal to refund entry fees is a tactic to maintain revenue and profit will find that legally the “no refunds” clause of the participant contract is both clear and not unconscionable. Any claim to the contrary is a dubious proposition at best.
In January, TriNation followed a Stateside class-action lawsuit against Ironman over lack of refunds due to cancellation of races because of the Covid-19 pandemic . A United States judge brought the case to an end with the summary judgment “No refunds’ means exactly what it says — no refunds.”
